The Law and Economics of the Design of Bilateral Investment Treaties

Over a series of three articles, Mohammad explores and problematizes the role economic theory plays in the design of the contemporary investment regime. The common theme among the three articles is the exploration of how international lawyers deploy economic theories, such as economic efficiency and comparative advantage, to justify the design of bilateral investment treaties, the main instruments that regulate foreign direct investment internationally. The three articles also investigate how lawyers overcome the methodological differences between law and economics and how close the resulting institutions get to the expectations of the economists.
