In its 2023 Sackett decision, the Supreme Court severely restricted EPA’s jurisdiction under the Clean Water Act to regulate the nation’s waters. In light of the decision, states are left to take the federal government’s water-protection role. The Environmental Law Society, Harvard Environmental Law Review, and ACS will be leading a moderated panel with attorneys from the MA AG office, the NY AG office, and the Environmental Council of the States to discuss how states may address the challenge of keeping our waters clean and safe.
