Gender Identity, Sexual Orientation, and the Law

This course provides a comprehensive overview of the law surrounding LGBTQ+ rights, with particular focus on constitutional law, statutory protection, and litigation strategy. Students will analyze landmark decisions and emerging legal challenges across multiple doctrinal areas, including substantive due process, equal protection, free speech, religious liberty, and federalism. The course traces the evolution of LGBTQ+ rights jurisprudence from Bowers v. Hardwick to contemporary cases, with an emphasis on doctrinal development and the legal framework that shapes current advocacy and potential policy responses. Students will engage with foundational cases including Romer v. Evans, Lawrence v. Texas, Obergefell v. Hodges, Bostock v. Clayton County, Dobbs v. Jackson Women’s Health Org., among others.
