Abstract: The Harvard Law School Human Rights Program convened a Workshop in October 2020, for the purpose of exploring in a comparative and cross-disciplinary manner the concept of indirect discrimination (or practices with discriminatory impact) on the basis of sexual orientation or gender identity. This report presents a summary of the discussion, as well as five individual papers prepared for discussion at the Workshop, preventing divergent views on how arguments regarding indirect discrimination are best understood and best used in the context of sexual orientation or gender identity.
