Abstract: This brief addresses the relationship of the class action to the law of Article III justiciability to inform the question presented in Microsoft Corp. v. Baker, No. 15-147. The brief discusses the function of the class action and shows that the existing law of Article III justiciability takes that function into account in determining whether a party can appeal the denial of class certification.
