Fair Trial

Students will write a paper (1500 words) and an exam essay (500 words), both due at the end of the exam period.

This is a course about jury as an expression of WE the People in American constitutional law. Jury as key to Sixth Amendment and Seven Amendments protections of liberty and property.

Liberty will be our focus. We will examine the rationale behind the rights enshrined in the Sixth Amendment and explore how and why the guarantees of jury trial as a fundamental check on state power have eroded.

Are we as a class able to model fair jury trial? What is an “impartial jury” in a world of power imbalances, structural inequities, and implicit biases?

Limit of 50 students.
