Abstract: This article was originally delivered as the Mellon Lecture at the University of Pittsburgh School of Law on April 18, 1987. Before his death on February 24, 1989, Professor Bator asked Professor Charles Fried of the Harvard Law School to edit and oversee the publication of his text.
