Private Wrongs and Discrimination
In my dissertation, I examine the relationship between private law and equality. Drawing on private law theory and moral philosophy, particularly contractualism, I investigate the foundations and limitations of central private law doctrines, including reasonableness in negligence. The project explores how legal doctrines governing interactions between private individuals can incorporate concerns of equal standing and equal respect. Using wrongful discrimination as a case study, I examine whether discrimination can be understood as a private wrong rather than as a matter of public law or distributive justice. More broadly, I seek to develop a theoretical framework for understanding how private law responds to inequality and shapes interpersonal relations.
