Case: Adam’s Apple Markets v. Aphrodite Cosmetics

A writ of certiorari is granted on the following two questions:

  1. Whether Petitioner has prudential standing to bring an unfair competition claim under the Lanham Act §43(a), 15 U.S.C. §1125(a).
  2. Whether Respondent’s statements about its animal testing practices and policies constitute noncommercial speech such that they are not subject to a claim under the Lanham Act §43(a), 15 U.S.C. §1125(a).
