United States v. Sineneng-Smith Supreme Court Moot

Moot argument for respondent in United States v. Sineneng-Smith, No. 19-67, before a panel of faculty members. The question presented is whether the federal criminal prohibition against encouraging or inducing illegal immigration for commercial advantage or private financial gain, in violation of 8 U.S.C. § 1324(a)(1)(A)(iv) and (B)(i), is facially unconstitutional. Arguing on respondent’s behalf is Mark C. Fleming (HLS ’97), a partner at WilmerHale LLP in Boston. Professors Andrew Crespo, Richard Fallon, and Mark Tushnet will serve as panelists. Audience members will be required to disclaim any conflicts and maintain a strict confidentiality.
