HIALSA Event: How International should International Arbitration be?

While answering this question, Professor Franco Ferrari (NYU Law School) will address the importance of international standards and interpretations–as opposed to domestic ones–in the international arbitration context. Ferrari posits that the answer cannot disregard the national rules applicable to a given arbitration, the application of which is often triggered, by the arbitration being “international” in a given way. He will show that suggesting that arbitration should be as international as possible, without taking into account the restrictions set forth by the national rules applicable in a given case to a given issue, is detrimental to international arbitration and, if nothing else, does not (yet) correspond to reality.
