Hernández v. Mesa Moot Argument

Moot argument for petitioner in Hernández v. Mesa, No. 17-1678, before a panel of faculty members. The question presented is whether, when a plaintiff plausibly alleges that a rogue federal law-enforcement officer violated clearly established Fourth and Fifth Amendment rights for which there is no alternative legal remedy, the federal courts can and should recognize a damages claim under Bivens v. Six Unknown Named Agents of the Federal Bureau of Narcotics. Arguing on behalf of petitioner is Professor Stephen I. Vladeck, the A. Dalton Cross Professor in Law at the University of Texas School of Law. Audience members will be required to disclaim any conflicts and maintain a strict confidentiality.
