Both cases involved the DOJ analyzing whether bargaining leverage would change between suppliers of content and distributors of content as a result of the merger. The DOJ challenged AT&T-Time Warner in court and lost (with the appeal pending in the DC Circuit), while in contrast, the Disney-Fox merger was approved by the DOJ in just six months.
