“Ag-Gag” Anti-Whistleblower Laws: Rise, Fall, and Re-emergence

HLS Animal Law & Policy Program Executive Director, Chris Green, will be discussing state anti-whistleblower measures intended to prevent evidence gathering at agricultural facilities––otherwise known as “Ag-Gag” laws. Several of these statutes recently have been struck down by federal courts as unconstitutional on first amendment grounds.

As a result, some states now are passing revised versions that either shift to creating civil remedies or criminalize in a way they hope will pass additional constitutional scrutiny. This talk will examine the origin of Ag-Gag laws, their rapid rise at the start of the current decade, legal challenges mounted by animal advocates, and the latest legislative responses.
