International Corporate Debt Solutions and Cross-Border Insolvency

This course will focus on the issues and strategies raised when a multi-national corporate group faces insolvency in more than one jurisdiction. Forms of cross-border cooperation (or conflict) will be examined, including the UNCITRAL Model Law on Cross-Border Insolvency (and its U.S. analogue, Chapter 15 of the U.S. Bankruptcy Code), the European Union Insolvency Regulation and court to court protocols. The course will follow one or more case studies of the failure of a hypothetical multinational group and include review and interpretation of corporate bank and bond documentation as well as application of recent decisions in the cross-border insolvency arena.

Note: This course will meet on the following dates: January 30, February 6, 13, 27, March 6, 13, and 27.
